This bibliographical study involved first the exploitation of four data-banks: Medline, CNRS, Bioethics and AIDS, with the following key words (in conjunction with AIDS): ethics, human rights, confidentiality, legislation, jurisprudence. A total of 412 references were listed between 1983 and the end of 1987. Examination of the quantitative increase of articles over these years shows that, while references to AIDS and/or HIV infection--referred to as 'AIDS' for brevity--increased by about one third per year, the number of papers treating ethical problems (...) linked to AIDS doubled each year. This increase makes it clear that these problems are important and pressing, that they are evolving rapidly and can be given no easy solution. After reading and analysis of accessible articles in readily comprehensible languages, the different themes can be classified in two categories: 1: Measures intended to protect society (starting with the most coercive); quarantine and isolation; discriminatory measures concerning specific groups; non-respect of the confidential nature of medical information; application of the penal code; screening; obligatory declaration and registration; testing of blood given by donors; vaccination and medical innovations, therapeutic assays; information, education. 2. Measures intended to protect the individual: fundamental rights of the patient: his/her right to confidentiality, to information and to treatment; civil rights: civil liberty, right to education, right to work, etc...; rights of the healthy individual: right of those in contact with the patients, safety of hospital staff, of those receiving blood-transfusions, etc... The legislation adopted in the various countries and the main opinions to be found in these articles are listed and analysed, and for each particular theme it is possible to refer to a list of the 232 most important articles. While the debate seems to concentrate on the conflict between the right of society to protect itself against the spread of infection and the 'civil' rights of the infected minorities, our conclusion tends to reduce this antagonism, showing that, particularly as far as the confidential nature of medical information is concerned, measures intended to protect the individual also protect society. Background: Demand for organisational ethics capacity is growing in health organisations, particularly among managers. The role of clinical ethicists in, and perspective on, organisational ethics has not been well described or documented in the literature. Objective: To describe clinical ethicists’ perspectives on organisational ethics issues in their hospitals, their institutional role in relation to organisational ethics, and their perceived effectiveness in helping to address organisational ethics issues. Design and Setting: Qualitative case study involving semi-structured interviews with 18 clinical ethicists across (...) 13 health organisations in Toronto, Canada. Results: From the clinical ethicists’ perspective, the most pressing organisational ethics issues in their organisations are: resource allocation, staff moral distress linked to the organisation’s moral climate, conflicts of interest, and clinical issues with a significant organisational dimension. Clinical ethicists were consulted in particular on issues related to staff moral distress and clinical issues with an organisational dimension. Some ethicists described being increasingly consulted on resource allocation, conflicts of interest, and other corporate decisions. Many clinical ethicists felt they lacked sufficient knowledge and understanding of organisational decision-making processes, training in organisational ethics, and access to organisational ethics tools to deal effectively with the increasing demand for organisational ethics support. Conclusion: Growing demand for organisational ethics expertise in healthcare institutions is reshaping the role of clinical ethicists. Effectiveness in organisational ethics entails a re-evaluation of clinical ethics training to include capacity building in organisational ethics and organisational decision-making processes as a complement to traditional clinical ethics education. ABSTRACTIn everyday situations, people regularly receive information from large groups of people and from single experts. Although lay opinions and expert opinions have been studied extensively in isolation, the present study examined the relationship between the two by asking how many laypeople are needed to counter an expert opinion. A Bayesian formalisation allowed the prescription of this quantity. Participants were subsequently asked to assess how many laypeople are needed in different situations. The results demonstrate that people are sensitive to the (...) relevant factors identified for determining how many lay opinions are required to counteract a single expert opinion. People's assessments were fairly good in line with Bayesian predictions. (shrink)

A biblical approach to reconciling God’s sovereignty with creaturely responsibility should avoid the extremes of global occasionalism and completely autonomous creatures. This paper evaluates the standard intermediary solutions offered by conservationists and concurrentists. It argues that while each contributes insights which a satisfactory account should retain, none is fully adequate. Even Leibniz’s sophisticated response, which accounts for providence, miracles, and moral responsibility, unacceptably abridges creaturely power to implement decisions. My alternative proposal seeks to explain how creatures can retain full responsibility (...) for their actions even though God reserves the right to override creaturely power with His greater power. If the words in Spinoza’s Ethics are considered as symbols, then certain words in the definitions of the Ethics can be replaced with symbols from set theory and we can reexamine Spinoza’s first definitions within a logical–mathematical frame. The authors believe that, some aspects of Spinoza’s work can be explained and illustrated through mathematics. A semantic relation between the definitions of the philosopher and set theory is presented. It is explained each chosen symbol. The ontological argument is developed through modal (...) logic. This study brings light to the concepts of State and Government in the thought of Marsilio de Padua pointing out to profoundly modern institutions present in the reflection of this medieval philosopher. We attempt to show that Marsilio de Padua reflects based on Aristotle´s categories, but proposes a State and Government conception different from that common place of medieval politics as he insists on the need of the popular consent as a criterion of political legitimacy. -/- O estudo explicita os (...) conceitos de Estado e de Governo no pensamento de Marsílio de Pádua apontando as intuições profundamente modernas presentes na reflexão desse filósofo medieval. At the start of her vigorously argued and classic article, “Modern Moral Philosophy,” G. E. M. Anscombe stated three focal theses. First, that philosophers of the time needed to dispense with investigation into talk of what is morally right, wrong; permissible, forbidden, required; and of moral obligation or duty, what we morally ought to do. Second, there was no adequate philosophical psychology then available of the sort needed for doing good moral philosophy. Third, the differences among the modernist moral philosophers (...) that had been most widely discussed were not as important as what they agreed on. I wish here to make some remarks about the sequel. More specifically, I will briefly discuss some aspects of how things have since played out with the first two theses, in order to say something about the relation between the first and second theses and about the state of things with respect to her third thesis, especially as it impacts today's medical ethics, a field of inquiry that barely existed at the time Anscombe wrote “Modern Moral Philosophy.&rdquo. Examines the relation between empiricism and realism. Mackie criticizes Locke's arguments against innate ideas. He draws a distinction between ‘minimal’ and ‘authoritative’ senses of knowledge and claims that innate knowledge is only possible in the minimal sense. Mackie argues that there is no necessary conflict between empiricism and realism. He concludes that it is possible to endorse both an empirical basis for our actual knowledge of the world as well as to accept the importance of certain innate propensities that contribute (...) to that knowledge. Chris Tucker's paper on the hiddenness argument seeks to turn aside a way of defending the latter which he calls the value argument. But the value argument can withstand Tucker's criticisms. In any case, an alternative argument capable of doing the same job is suggested by his own emphasis on free will.

Although Adam Smith’s thoughts on education have attracted significant scholarly attention, his ideas on how the primary education of children should be funded has been relatively neglected. I re-examine Smith’s nuanced position and argue that Smith had a more flexible view of education funding than has hitherto been recognised. By extending the Scottish educational model, Smith proposed a direct contribution of government to the costs of educating poor children. In addition, his discussion of scholarships indicate that he favoured further indirect (...) subsidies to education. These significant subsidies were designed to ensure that education was accessible and affordable to most people in society, who would only have to contribute a small sum. Furthermore, there is reason to believe that for pupils whose family were unable to support their education, Smith might have favoured a full payment of their fees. Situating Smith’s intervention on education funding within the context of the English and Scottish educational systems reveals a discussion of the role of government in society. The Smithian state that emerges from such a reading actively intervenes where necessary to prevent ‘a publick evil’ (WN V.i.f.60). (shrink)

In a previous essay we demonstrated that quantum mechanical formalism is incompatible with some necessary principles of the mechanism conception still dominant in the physicist’s community. In this paper we show, based on recent empirical evidence in quantum physics, the inevitability of abandoning the old mechanism conception and to construct a new one in which physical reality is seen as a representation which refers to relations established through operations made by us in a world that we are determining. This change (...) is profound and radical, with immediate consequences on both Ontology and Epistemology. This work is our contribution to try to make more concrete how this new conception of the world might be. (shrink)
